Booking Terms and Conditions
Aberafon Limited (“we” “our” and “us”) is a limited liability company with its registered office at Ty Isaf, Taliaris, Llandeilo, Carmarthenshire.
Aberafon Limited operates the property known as Aberafon, Llangrannog, Llandysul, Ceredigion, SA44 6SW.
Reference to “you” and “your”, means to the lead booker, and all those on whose behalf a booking is made by the lead booker.
- Accuracy of Information
- We strive for accuracy in our advertising, but errors may occur and prices may change as a result. If this happens, we will notify you as soon as possible.
- You must confirm and agree the price and confirm all details that are important to you before booking.
- We are not responsible or liable for your booking errors.
- Agreement
- These booking terms and conditions together with any other written information provided by us to you and agreed by us in writing and before you pay us a booking deposit of 25% forms the agreement between us. The agreement is only binding on us once we receive payment of the 25% deposit (see clause 7 below). In the event of any conflict between information supplied and these terms and condition, these terms and conditions shall prevail.
- This agreement binds you (the lead booker) and all members of the party who are part of the booking. It is the lead booker’s responsibility to ensure that all adult members of your party accept the terms set out in these terms & conditions.
- Failure by you to disclose all relevant information or comply with these terms may lead to termination of the contract and cancellation of the booking at our discretion.
- You warrant that you are at least 18 years of age, and have authority on behalf of all members of your party to proceed with the booking in accordance with these terms and conditions.
- Payment
- Please follow our payment instructions at all times.
- We accept no responsibility for payments that you may make that are intended for us but are made to third parties (whether as a result of cyber fraud or otherwise). It is your responsibility to ensure that payment is made to our bank account and to verify (whether by phone or otherwise) that the details you have are correct. Aberafon Limited will show as the intended payee in any bank transaction.
- Our bank details will not change during the agreement between you and us.
- Deposits are non-refundable.
- Late payment may result in cancellation.
- Insurance
- You must have suitable travel insurance for your party, as well as for your dogs (if any) including coverage for cancellations, medical issues, repatriation, and COVID-19 and in the case of dogs, cover for any injury or damage that they may cause during your stay.
- As you are asked to ensure that you have suitable insurance cover, we limit to the fullest extent permissible by law our liability to you and any member of your party. Our maximum liability shall not exceed the price agreed with us for your booking.
- Special Requests
- Special requests must be made at booking and agreed in writing to be binding on us.
- We will try to accommodate reasonable requests but cannot guarantee them.
- Medical Matters and Health
- COVID-19: You acknowledge the risk of exposure to the Covid19 virus and other viruses and must follow all guidelines that may apply from time to time. We are not liable for COVID-19 related issues, losses, cancellations or costs that you may incur. You are asked to ensure that your party is insured in respect of such risks.
- Health Issues: It is your responsibility to inform us of any medical issues or disabilities that may affect our decision to accept a booking. In that respect, please note that Aberafon is not recommended for anyone with mobility issues due to the number of steps and the narrow staircase.
- Price
- The price provided for your proposed stay will be the price payable to us unless late charges or agreed variations apply pursuant to these booking terms and conditions. We do reserve the right to increase the price if, for example, the party size increases, we agree to change the dates, we receive change requests, we incur taxes, or if we incur third-party costs. Any price changes will be notified to you and will be payable within 7 days.
- Time is of the essence in respect of all payments to us.
- A non refundable deposit of 25% of the agreed price is payable to secure the booking.
- The booking is not confirmed or guaranteed until the 25% deposit is received by us in our bank account and we have confirmed safe receipt of the same in writing.
- The balance of the agreed price is payable no less than 12 weeks before your arrival date plus a damage deposit. The damage deposit is usually £150 but we reserve the right to increase the amount based on party size or other risk factors that we consider reasonable.
- If the balance is not paid by the due date (i.e. 12 weeks before your stay is due to commence) we may, with no liability to you, cancel your stay and retain the 25% deposit.
- Your booking cannot be cancelled, postponed or changed once the full price agreed for your stay has been paid to us, unless expressly agreed by us in writing.
- Your damage deposit will be refunded upon a satisfactory inspection of Aberafon as soon as is reasonably practicable after your stay. If we deem that a deduction should be made from your damage deposit, you will be notified of the reasons in writing. If the damage deposit that we hold and may retain is not sufficient to cover the cost of the damage caused to Aberafon during your stay, you warrant on behalf of yourself and your party to indemnify us in respect of all remedial costs and/or replacement costs that we incur to include any loss of profits caused by other bookings having to be cancelled or delayed.
- If there is a disagreement over the amount that you should reasonably be charged for the damage caused during your stay, you and we agree to use best endeavours to resolve the matter within 7 days. If after 7 days the matter cannot be resolved, you agree that an independent surveyor may be instructed and you and we agree to be bound by his or her decision which shall be final.
- Changes by You
- Please contact us by email as soon as possible if you wish to cancel or propose changes to your booking.
- Changes cannot be guaranteed and may incur charges.
- No change will be deemed to have been agreed unless confirmed in writing by us.
- Charges for Your Cancellation or Changes
- Cancellation charges are based on the total cost and time of cancellation.
- Your cancellation will automatically forfeit your 25% deposit.
- Any cancellation that you notify us of more than 12 weeks before your scheduled arrival will not result in a cancellation charge.
- Any booking cancelled within 12 weeks of your proposed arrival will result in the full price being due unless we have been able to re-let Aberafon for the relevant period. If we have been able to re-let Aberafon for that period, we may at our discretion reimburse you a sum that we consider reasonable taking into account the time and costs involved. We shall not under any circumstances be required to pay you more than 75% of the price that we had originally agreed with you.
- Changes and Cancellation by Us
- We may cancel your booking at any time for any reason. We must do so in writing. We will, if possible, offer you an explanation.
- Should we cancel, save for unavoidable or extraordinary circumstances such as those specified in clause 11 below, we will issue you with a full refund within 1 business day. We shall have no further liability to you.
- If we propose changes, you may accept the changes or receive a full refund.
- We are not liable to you for other losses, costs or inconvenience due to changes or cancellations by us.
- Unavoidable and Extraordinary Circumstances (“Force Majeure”)
- We are not liable for price reductions, cancelations, losses, costs or compensation if we cannot fulfil the contract due to events beyond our control (e.g., war, terrorism, pandemic, natural disaster, storms).
- Concerns During Your Stay
- If you have concerns during your stay, please inform us immediately in writing.
- We will promptly investigate any complaints raised and notify you of our findings. We will use our reasonable endeavours to put right any concern that is deemed to be genuine and to have been raised in good faith.
- Your Behaviour
- You are required to follow all house rules and be respectful to all of Aberafon’s neighbours.
- We may terminate your stay immediately in writing if your behaviour is deemed by us to be disruptive or unsafe. We shall have no liability to you or any obligation to make any refunds if we consider that such action is warranted in the circumstances.
- No stag or hen does are permitted under any circumstances. Your booking will be immediately terminated if we reasonably consider that this is the purpose of the booking.
- If you cause damage to third party property, you shall remain liable for the costs in full and indemnify us fully in respect of any third party claims arising from your stay.
- Our Responsibility
- We make reasonable efforts to indicate safety hazards and have a fire evacuation policy. Please read the guest manual before arrival to ensure that you are familiar with all matters including safety and fire prevention and evacuation procedures.
- You are responsible for inspecting the property and noting hazards, particularly those that may impact anyone under the age of 18.
- Our liability is limited, and we are not responsible for issues arising from your actions, third-party actions, or unavoidable circumstances.
- We shall have no liability for any personal belongings lost or left at Aberafon. We shall also have no liability for any personal property damaged or stolen during your stay. You agree that we may dispose, with no liability to you, any belongings left at the property at the end of your stay.
- Your Obligations
- Pay for damages or losses in accordance with these terms and conditions.
- Take care of Aberafon, follow the house guide that will be issued to you before your arrival and keep Aberafon clean during your stay and when you leave.
- Dispose of all rubbish in accordance with the house manual.
- Do not light candles or have any naked flames in or around Aberafon.
- Inform us of any problems.
- Permit us access for inspections or maintenance at all hours.
- Do not sublet or exceed the maximum number of guests being the number specified and notified to us up to a maximum of 10.
- Do not cause a nuisance.
- You must ensure that you are insured for any valuable belongings that may be lost, damaged or stolen whilst you stay at the house.
- Pets
- Up to two dogs may be allowed with the following conditions.
- Your dogs must be house-trained, non-aggressive, and insured for public liability.
- Dogs must not cause worry or upset to passers by at any time and should be kept on a lead whilst outside the house. You shall assume all responsibility and liability for any injury or damage caused by your dog.
- You are required to follow and comply with rules issued from time to time by Ceredigion County Council that affect the use of certain beaches by dogs at certain times of the year.
- You are required to keep dogs under control at all times in and outside of the house.
- No banned breeds or excessive barking allowed.
- Dogs may not be left unattended, may not go to the upstairs and must be cleaned up after.
- You agree to leave Aberafon if we receive complaints from neighbours or authorities with regard to your dogs.
- Electric Vehicle Charging
- You are permitted to use the designated pay-as-you-go charger only.
- You agree that you will not charge vehicles via other power sockets which you accept may pose a fire hazard for which you will be liable to us, our insurers and or to affected third parties.
- We may apply additional charges for excessive energy use.
- Other Important Terms
- The remaining terms of this agreement remain valid even if a part is deemed unlawful.
- We can enforce the contract even if we delay.
- The contract is between you and us only. It may not be enforced by a third party.
- English & Welsh law and the courts of England & Wales have exclusive jurisdiction to determine any dispute, other than where an alternative dispute resolution process has been agreed in this agreement.
- Unless otherwise agreed, Check ins normally commence at 4pm on the arrival date and guests are required to leave the rental by 10am on the day of departure. Failure to do so may result in you being charged a further day’s rental.
- You must not use the property except for the purpose of a holiday.
- Smoking and vaping is never allowed in Aberafon.
- Vaping or smoking anywhere inside Aberafon will result in immediate termination of occupancy and forfeiture of all payments. This must be strictly adhered to, and any damage or extra cleaning caused will be charged to you.
- When you leave you must ensure that all external doors are locked and windows are secured and the keys are returned to the key safe.
- Please make sure you switch off lights, heating, and any electrical appliances when you go out or leave Aberafon.
- Our property may not be removed from the house and all breakages must be reported in writing.
- You are responsible for the supervision of all persons aged 18 and under at all times.
- Fireworks, Chinese lanterns, firepits, candles and portable bbqs are prohibited.
